But the satisfaction that comes from such evil requests is still bad. It is evil to ask that someone be locked away for doing something to you, regardless of their crime, because its desiring something bad for someone. How can we be good if we desire that evil is done upon others?

I’m not saying that this guy shouldn’t be sent to prison, he should. but the reasoning should be “We all agreed not to fuck with each others property so don’t do it!” and the sentence should be “We can’t trust you so we’re going to make sure you can turn into someone better in an environment where you can’t cause damage.” The point of having the police and laws is prevention, not retaliation... if that makes any sense...

I think that prison should be a matter of rehabilitation, not punishment. I can understand why someone would want a criminal punished but it is, to an extent, impractical, the focus should be on making sure they do their sentence and then never go back to prison. make them learn something and find a way to give back to society. I understand that as the crime becomes more serious we find ourselves being less empathetic, and it is a normal way to feel, but we need to see them as human beings and we need to understand that we could be in similar circumstances if something went wrong.

I also can’t convince myself that I’d be honest or impartial if I was a judge, I think it’d be substantially harder than most people (heck, most judges too) think it is. One needs to abandon the thought of what someone deserves and focus on the law.

Interesting commentary. Do you subscribe to a religion? I know that in my work as an educator, it’s clear to me that at least with youth, punishment has very little helpful effect except in small doses on kids with lots of structure in their homes. Sort of like traffic fines on the law-abiding. Otherwise, it’s all about trying to develop a sense of personal discipline and emotional intelligence. I’m not sure how to accomplish that in a penitentiary among adults.

I am atheist.

Well, we can look at places with a small percentage of re encarceration. Normally these have a more humane rehabilitation program.

I think that the biggest barrier is that we think they don’t deserve it, but it rings true that most people don’t react to punishment as intended.

You’re right on the discipline and also emotional intelligence, I’m certain that a rehabilitation based on those could have a great effect.
